Subscription Terms and Conditions

1. Introduction

Welcome to Trusty Marketing Services - FZCO ("we", "our", or "us"). By subscribing to our services, you ("User," "Subscriber") agree to be bound by these Subscription Terms and Conditions.

If you do not agree to these terms, please do not subscribe to our services.

2. Definitions

For the purposes of this Agreement:

  1. "Subscription" refers to the paid service plan offered by us to Users.
  2. "Billing Cycle" means the recurring period for which a subscription fee is charged (e.g., monthly, yearly).
  3. "Service" means all-digital, content, and platform-based services provided by Trusty Marketing Services - FZCO.
  4. "User" refers to any individual or entity that subscribes to our service.

3. Subscription Plans and Billing

3.1. By subscribing, you agree to pay the applicable fees as listed on our website.

3.2. Our subscription plans, including pricing and features, are available on our website and may change at our discretion.

3.3. Subscription fees are charged at the start of each billing cycle using the payment method provided.

3.4. Unless cancelled, your subscription automatically renews at the end of each billing cycle.

3.5 All prices are in UAE Dirhams (AED), exclusive of VAT, unless stated otherwise.

3.6 Failure to process payment may result in service suspension or termination.

3.7 Price changes will be notified at least 30 days in advance and apply at the next billing cycle.

4. Free Trials and Promotional Offers

4.1. We may offer free trials or promotional discounts at our discretion.

4.2. If you do not cancel before the trial ends, your plan will convert to a paid subscription.

4.3. Any eligibility requirements for promotional offers will be clearly outlined on our website.

5. Cancellation and Refund Policy

5.1. If you are subscribed to a monthly plan, you may cancel your subscription at any time; however, we require at least 60 days’ written notice prior to the effective cancellation date. Charges will continue to apply during the notice period.

If you are subscribed to an annual plan, cancellation must be submitted at least 30 days before the end of your current billing cycle to avoid automatic renewal and associated charges.

5.2. Cancellations take effect at the end of the current billing cycle; you will not be charged again.

5.3. Refunds are only provided in cases of billing errors or service failures directly caused by us.

5.4. No refunds are issued for partial billing periods unless required by UAE consumer protection laws.

5.5. Refunds, if applicable, will be processed within 30 business days using the original payment method.

6. Account Responsibilities

6.1. You are responsible for maintaining the confidentiality of your account credentials.

6.2. Any unauthorized access or use must be reported immediately.

6.3. We are not liable for any loss or damage resulting from unauthorized account access.

7. Service Availability & Changes

7.1. We aim to provide 99.9% uptime, excluding scheduled maintenance.

7.2. We reserve the right to modify, suspend, or discontinue features of the service.

7.3. Notice of major changes will be provided where possible.

8. Prohibited Use & Fair Usage Policy

8.1. Users must not use our service for:

  1. Illegal, fraudulent, or harmful activities.
  2. Automated data scraping, hacking, or unauthorized access.
  3. Excessive bandwidth usage affecting platform performance.

8.2. Violation of this policy may result in immediate termination without refund.

9. Privacy & Data Protection

9.1. We process personal data in compliance with our Privacy Policy here.

9.2. By subscribing, you consent to the collection, storage, and processing of your personal data.

9.3. Users may access, update, or request deletion of their data as per UAE Personal Data Protection Law (PDPL).

9.4. We do not sell personal data to third parties.

10. Intellectual Property Rights

10.1. All content, software, and materials provided through our service are owned by Trusty Marketing Services - FZCO or its licensors.

10.2. Users may not:

  1. Copy, modify, or distribute service materials.
  2. Resell, sublicense, or exploit content for commercial use.
  3. Reverse-engineer or attempt to extract source code.

Unauthorized use may result in legal action.

11. Termination of Subscription

11.1. We may terminate or suspend your subscription for:

  1. Breaching these terms.
  2. Non-payment of subscription fees.
  3. Misuse or unauthorized access.

11.2. Upon termination, your access to the service will be revoked.

11.3. What happens to your data?

Account data will be retained for 180 days before permanent deletion, unless required by law.

11.4. Upon termination or cancellation of your Subscription for any reason, all outstanding and unpaid Fees attributable to the remaining term of the Subscription shall become immediately due and payable in full to us. We reserve the right to initiate legal proceedings, including but not limited to claims for breach of contract and recovery of debt, against you and, where applicable, your Affiliates. This includes the right to seek interest, legal costs, and any other remedies available under applicable law.

11.5. If any invoiced amount is not received by us by the applicable due date, then without limiting our rights or remedies, such amounts may accrue interest at the rate of 1% per month (or the maximum rate permitted by applicable law, if lower), calculated monthly until paid in full.

12. Limitation of Liability

12.1. Our services are provided on an "as is" basis without warranties.

12.2. We are not liable for:

  1. Indirect, incidental, or consequential damages.
  2. Interruptions beyond our control (force majeure).

13. Governing Law & Dispute Resolution

13.1. These Terms are governed by the laws of the United Arab Emirates.

13.3. Any disputes shall be exclusively resolved by arbitration at the Dubai International Arbitration Centre (DIAC) under its rules

14. Updates to Terms & Conditions

14.1. We reserve the right to update or modify these terms at any time.

14.2. Continued use after updates constitutes acceptance.
